Consumer Information Sheet & Terms of Service Summary
Authorization to Perform Services
This agreement authorizes World Class Lawns to perform lawn care services at the service address listed on Page 1.
Environmental regulations, seasonal conditions, and lawn health may require adjustments to the treatment program. Turf products have limited longevity, and additional applications (including weed control, fungicides, or insect control) may be applied as needed between scheduled services.
Products may be adjusted to meet the specific needs of your lawn. Not all products are included in every lawn care program.
Service Standards
World Class Lawns agrees to:
Perform all contracted services in a safe and timely manner
Follow product label requirements and industry standards
Exercise professional judgment and discretion in treatment applications
Flag signs and/or service notices will be left after each treatment. Flags may be removed by the homeowner after 72 hours.
Some products require watering after application. The homeowner agrees to follow all post-treatment instructions provided.
Customer Responsibilities
The homeowner agrees to:
Follow all watering and post-application instructions
Keep people and pets off treated areas for the required time period
Notify World Class Lawns at least 72 hours in advance of any outdoor activities or events that may affect scheduled service
Maintain proper lawn care practices, including mowing and watering
Failure to follow instructions or maintain the lawn may impact treatment effectiveness.
Effectiveness of Treatments
The effectiveness of materials applied depends on factors beyond the control of World Class Lawns, including but not limited to:
Soil condition
Type of grass
Drainage and grading
Adequate watering
Weather conditions
Mowing habits
Lawn usage
Because of these variables, complete control, prevention, or eradication of weeds, insects, or disease cannot be guaranteed.
Grassy Weeds
Crabgrass
Control effectiveness depends on proper application timing, climate, soil conditions, and ongoing lawn care. While high-quality products and services are provided, complete prevention or eradication cannot be guaranteed.
Nutsedge
Nutsedge is a persistent and invasive weed that can be difficult to fully eliminate. World Class Lawns provides products and services designed to manage and suppress nutsedge growth; however, complete eradication cannot be guaranteed. Results may vary depending on environmental conditions, soil health, and lawn maintenance practices.
If nutsedge treatment is not included in the customer’s current lawn care program and is requested as an additional service, it may be subject to a separate charge. An inspection will be conducted, and the customer will be provided with the cost of the additional treatment for approval prior to service.
Kylinga
Kylinga is an aggressive and invasive grassy weed that may require multiple treatments for control. World Class Lawns offers products and services intended to manage and reduce kylinga populations; however, complete eradication cannot be guaranteed. Treatment results may vary based on environmental factors and ongoing lawn care.
If kylinga treatment is not included in the customer’s current lawn care program and is requested as an additional service, it may be subject to a separate charge. An inspection will be conducted, and the customer will be provided with the cost of the additional treatment for approval prior to service.
Limitation of Liability
To the fullest extent permitted by law, World Class Lawns shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to loss of profit, property damage, or personal injury arising from the use or misuse of its products or services.
World Class Lawns is not responsible for:
Weather-related conditions, including drought, flooding, excessive heat, humidity, wind, or rainfall
Improper maintenance or failure to adequately water by the customer
Death or decline of plants or trees
Exposed or hidden cables, wires, sprinkler components, irrigation lines, underground utilities, or invisible pet fencing
Damage to fences, gates, or other structures
Damage resulting from materials, equipment, or services not supplied by World Class Lawns
Pre-existing lawn or soil conditions
Weather & Environmental Conditions Disclaimer
Lawn treatment effectiveness depends on proper weather conditions.
Company is not responsible for reduced results due to drought, excessive rain, flooding, heat waves, or other extreme weather.
Service may be rescheduled due to weather.
Example:
“Results may vary due to weather conditions beyond our control, including drought, excessive rainfall, or extreme temperatures.”
Pre-Existing Conditions Disclaimer
Not responsible for:
Existing lawn disease, Fungus, Grub damage, Poor soil conditions
Compacted soil, Pet damage, Shade damage, Prior chemical damage
Example:
“We are not responsible for pre-existing lawn conditions, soil deficiencies, insect infestations, or disease present prior to service.”
Pesticide / Herbicide Risk Disclosure (NJDEP Compliance)
New Jersey has strict pesticide regulations under the NJ Pesticide Control Act.
Include:
Treatments involve EPA-registered products.
Temporary discoloration or turf stress may occur.
Keep children and pets off treated areas until dry (or as labeled).
Customer must notify company of wells, sensitive areas, or water bodies.
Example:
“All pesticides applied are registered with the EPA and NJDEP. Customers must keep people and pets off treated areas until dry unless otherwise stated on product labeling.”
Drift & Neighboring Property Disclaimer
Wind may cause minor drift despite precautions.
Not responsible for neighboring property conditions unless due to negligence.
Underground & Hidden Hazards Disclaimer
Not responsible for damage to:
Invisible dog fences, Sprinkler heads marked or not marked, Underground wiring
Landscape lighting, Unmarked obstacles, items left on lawn areas including swing sets
Example:
“Customer is responsible for clearly marking all sprinkler heads, invisible fencing, and underground installations.”
Property Measurements
While measurement accuracy is a priority, property measurements may vary due to irregular lot lines or site conditions.
Compensation
World Class Lawns shall receive payment for services rendered in the amount(s) listed on Page 1 of this agreement. Agreed pricing is guaranteed for the current season only.
Payment Options & Policies
We offer several convenient ways to pay for your lawn care program, including:
Credit Card Auto Bill Pay, Installment Billing, Check
Pay in Full
Pay your full balance in advance and we’ll waive all service and processing fees.
Installment Plan
Split your balance into five easy payments, due on:
• March 1 • May 1 • June 15 • August 1 • September 15
Each installment includes a $5 service fee per installment.
Late Payments:
Payments not received within 30 days of the due date may incur a $15 late fee, and service may be paused until the account is current.
Additional late fees of $15 will be applied every 30 days until the account is brought current.
Credit Card Auto Bill Pay
Set it and forget it! Enroll in credit card auto bill pay and we’ll charge your card on each installment date.
• A 3% credit card processing fee will be added to all credit card transactions
• A $5 service fee per installment applies
• Please keep your card information up to date
• If a payment is declined, we’ll retry during the 30-day grace period
• Additional late fees of $15 will be applied every 30 days until the account is brought current
Pay Per Service
Pay when each service is completed. This option applies to the following programs:
• Tree and Shrub Spray • Tick / Mosquito Spraying • Deep Root Injection for Trees and Shrubs
• Accepted: check, cash, or credit card
• A $5 processing fee per service applies
• A 3% credit card processing fee will be added to all credit card payments
Refund Policy
Refunds are available and will be prorated based on the services that have already been provided up to the cancellation date.
Should promotional discounts have been applied during the initial purchase, they will be reinstated contingent upon meeting the stipulation that the promotion pertains to a completed season.
Credit Card Authorization & Backup Billing
Customer must provide valid credit card information to be kept on file.
In the event that payments are not made in accordance with the Customer’s selected payment plan, World Class Lawns is authorized to charge the credit card on file for any outstanding balance, including applicable service fees, late fees, and processing charges.
It is the Customer’s responsibility to ensure that all credit card information on file is current and valid.
Estimate Validity
All estimates are valid for thirty (30) days from the date they are issued.
Customers are advised to sign into the World Class Lawns customer portal to view, modify, and accept the estimate.
Customers should make every effort to review and approve the proposal within this 30-day period to secure the quoted pricing and services.
Spring Seeding – Important Information
There is a common misconception about spring seeding. Spring is the most challenging time of year to establish new grass. During the spring, weed competition is significantly higher than in the fall. Many weeds germinate aggressively at this time and are often stronger than new grass seedlings.
Because weed control products will also damage or kill new seedlings, weeds cannot be safely treated during spring seeding, which further increases the difficulty of success.
For best results, August through October is the ideal time for seeding, weather permitting.
Patience is required when reseeding. In some cases, two or three seeding applications may be necessary to achieve the desired lawn coverage.
Seeding Policy & Warranty
All seedings and re-seedings are provided without warranty.
World Class Lawns will make every reasonable effort to promote successful germination; however, results are affected by factors beyond our control, including weather, soil conditions, irrigation, birds and foot traffic.
All seedings are based on a single application rate.
If additional re-seeding is needed, the customer will be notified of the cost prior to any additional applications.
Insurance and Licenses
World Class Lawns will maintain at all times adequate public liability insurance.
The company and its technicians are properly licensed by the New Jersey Department of Environmental Protection (NJDEP) as required by law.
Collection
In the event that legal action is necessary to collect a past-due account, the Customer agrees to be responsible for all collection costs incurred by World Class Lawns, including attorney fees and court costs.
Binding Agreement
This contract shall be binding upon the successors of World Class Lawns and the heirs, administrators, and executors of the Customer.
The agreement shall remain in effect in perpetuity, or until officially cancelled by either party in accordance with the cancellation terms outlined herein.
Entire Agreement
This contract contains the entire agreement between the parties. There are no other promises, conditions, or agreements, whether oral or written, relating to the subject matter of this contract.
Severability & Cancellation
If any provision of this contract is found to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable.
If a court determines that a provision is invalid but could be valid if limited in scope, that provision shall be deemed modified to the extent necessary to make it enforceable.
The Customer or World Class Lawns may cancel this contract at any time by providing written notice at least thirty (30) days prior to the intended cancellation date. All outstanding balances must be paid in full prior to cancellation.
